N2: Rent Increase — Unit Not Covered by the Guideline
Rent increase notice for units exempt from the guideline (generally first occupied for residential purposes after November 15, 2018).
The current rules
At least 90 days' written notice.
At least 12 months since the last increase.
No cap on the amount — but the exemption must genuinely apply to the unit.
What voids it
Using an N2 on a unit that is actually guideline-covered — the increase is invalid and collecting it can be an illegal charge.
Less than 90 days' notice or less than 12 months since the last increase.
